This is the Boston the Harbor Court Case’s 2006 “Second Stipulation,” which not only updates the levels of control (7.29 MG for Alewife Brook), but also describes the legal responsibility of the CSO outfalls.
According to the Second Stipulation, all of the CSO outfalls in Exhibit B are the responsibility of MWRA. Exhibit B includes all of the Alewife Brook CSO outfalls.
This document describes that MWRA not only has the financial responsibility for all Alewife CSO outfalls, but also is required to “undertake such future corrective action as may be necessary to meet the CSO control requirements of the Clean Water Act, 33 U.S.C. § 1251”.
